Liability Waiver and Release of Claims

This Liability Waiver and Release of Claims (“Waiver”) is entered into by and between Mid Shore Animal and Home Sitting, LLC (“Service Provider”) and the undersigned Client (“Client”). By booking services the Client acknowledges and agrees to release the Service Provider from certain liabilities as set forth below.

1. GENERAL RELEASE OF LIABILITY

a. The Client acknowledges that animal sitting, animal walking, and home care services involve inherent risks, including but not limited to: animal injury, illness, escape, behavioral issues, property damage, or accidents caused by animals or external factors. The Client voluntarily assumes all such risks.
b. The Client hereby waives, releases, and discharges the Service Provider from any and all claims, demands, causes of action, damages, losses, or liabilities arising from the services provided, except in cases of gross negligence or willful misconduct.

2. PET-RELATED LIABILITY

a. The Client is solely responsible for any injuries, damages, or legal claims arising from their animal(s) during the service period. This includes but is not limited to:

  • Bites or attacks on people or other animals.

  • Property damage caused by the animal.

  • Transmission of disease or parasites from the animal to humans or other animals.
    b. In the event that the Service Provider is injured by the Client’s animal(s), the Client agrees to cover all medical expenses, lost wages, and associated costs incurred by the Service Provider.

3. HOME & PROPERTY LIABILITY

a. The Client understands that while the Service Provider will take reasonable precautions to protect the Client’s home and property, the Service Provider is not responsible for theft, property damage, or security breaches that occur during or after the service period.
b. The Client waives any claims against the Service Provider related to damages caused by malfunctioning home systems, including but not limited to: heating/cooling systems, plumbing, electrical issues, security systems, or acts of nature.

4. EMERGENCIES & VETERINARY CARE

a. In the event of an emergency, the Client authorizes the Service Provider to act in the best interest of the animal and/or home. The Client agrees that the Service Provider may seek emergency veterinary care or other necessary assistance as deemed appropriate.
b. The Client agrees to reimburse the Service Provider for all expenses incurred during an emergency, including but not limited to veterinary care, supplies, food, and temporary accommodations.

5. INDEMNIFICATION

The Client agrees to indemnify, defend, and hold harmless the Service Provider from any and all claims, lawsuits, liabilities, or damages arising from:

  • The Client’s animal(s) or their behavior.

  • The Client’s property or any third-party claims related to it.

  • Any injuries, losses, or damages sustained by the Client, their animal(s), or third parties during the service period.

6. FORCE MAJEURE

The Service Provider shall not be liable for any failure or delay in performance due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, governmental restrictions, or emergencies that prevent service fulfillment.

7. AGREEMENT TO TERMS

By booking services, the Client acknowledges that they have read, understood, and voluntarily agreed to this Liability Waiver and Release of Claims. The Client understands that they are waiving certain legal rights and accept full responsibility for their animal(s) and property.
